Power of Attorney

A legal document which allows a named individual to make decisions for you or act on your behalf should you no longer be able to make your own decisions or you do not want to; a power of attorney is an important decision to make as you want to be sure that the nominated person is able to responsibly act on your behalf and your best interest. If you are someone who travels frequently and you are considering having a Power of Attorney for a specific matter, A solicitor will be able to help you with this decision by preparing what is known as a General Power of Attorney on your behalf. This document however only lasts for a year. 

With years of experience in preparing and registering such important documents, a solicitor will be able draft the power of attorney to ensure it includes all the necessary information required including the details of the individuals you wish to appoint and how you want them to act on your behalf. 

Once the forms have been drafted, they will then need to be signed by you, your attorneys and also by your chosen witnesses. You will also be required to have the forms signed by what is known as a ‘certificate provider’. This individual will need to attest to your mental capacity and to confirm that you are fully informed as to what a power or attorney is and that you made the decision on your own. This person will need to be someone who has known you for at least two years and is also required to be a professional such as a GP; someone who is able to check your mental capacity on a professional level. 

When considering whether to have a Lasting Power of Attorney, it is important to know that there are two types: the Lasting Power of Attorney for Health and Welfare and a Last Power or Attorney for Property and Financial Matters.
